These Terms and Conditions of Sale (the “Terms of Sale”) govern the sale of founder packs for the game Hana on playhana.com, published by Studio 3NA, a French simplified joint-stock company (SAS) with share capital of €1 000, registered with the Perpignan Trade and Companies Register under number 992 999 144 (registered office SIRET: 992 999 144 00015), whose registered office is at APP 12, 6 Rue Antoni Gaudi, 66270 Le Soler, France (the “Studio”). Intra-community VAT number: FR83 992 999 144. Contact: contact@playhana.com.
Every order constitutes unconditional acceptance of these Terms of Sale, confirmed by ticking a checkbox during payment.
Founder packs (“Pass Alpha”, “Pack Deluxe”, “Pack Prestige”, “Pack Ultime”, “Pack Collection”) are digital content supplied without a physical medium. Depending on the pack, they include early access to game testing phases (Alpha, closed Beta), Nectar (virtual currency) and virtual cosmetic items (weapon skin styles, a character skin, a mount skin). Each pack's contents are detailed on the shop page at the time of purchase.
Prices are displayed in euros or US dollars, including all taxes. Applicable VAT is calculated according to the customer's country of residence in accordance with European regulations on electronically supplied services. Preorder prices apply during the preorder campaign, while stocks last; the Studio may change prices at any time, without affecting orders already confirmed.
Kickstarter pricing. During the preorder campaign, backers of Hana's Kickstarter campaign, regardless of their pledge amount, receive a 50 % discount on the full price of each pack bought for their own account, with the discounted price rounded to the nearest price ending in .99. The discount applies automatically when the verified email address of the Hana account matches the one used on Kickstarter; it does not apply to gifted packs (section 6), replaces the preorder price without combining with it, and ends with the preorder campaign. The Studio may request proof of a pledge and refuse the discount in the event of fraud or email impersonation.
Purchase requires a Hana account, created or signed into at payment (Google, Discord or email). Payment is made in a single transaction by bank card or, depending on the device and country, a wallet offered by the payment platform (Apple Pay, Google Pay), through the secure Stripe platform (PCI-DSS certification, PSD2 strong customer authentication). The Studio stores no banking data. The order is confirmed upon receipt of payment and immediately visible in the buyer's account; a payment receipt is sent by email and an invoice can be requested at contact@playhana.com.
Pack rewards are linked to the buyer's account immediately after payment confirmation. Alpha and Beta access is activated when the corresponding phases open; Nectar and cosmetic items are credited in game when the corresponding testing phases open.
The cosmetic choices offered by some packs (weapon skin styles, a character skin, a mount skin) are made at purchase and remain editable from the buyer's account until Alpha 1 launches, when they become permanently fixed.
Any pack may be purchased as a gift, up to 50 copies per order. Payment then links no rewards to the buyer's account: it generates one access key per copy (a code in the form HANA-XXXX-XXXX-XXXX), delivered to the buyer on the site, by email and in their account. Supply of digital content begins when the keys are delivered, with the buyer's express consent (section 7).
Under Article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for digital content supplied without a physical medium when performance has begun with the consumer's express consent and express waiver of their right of withdrawal. By ticking the checkbox during payment, the buyer requests immediate performance (linking the pack to their account, or immediately delivering access keys for a gifted pack) and expressly waives their 14-day right of withdrawal.
As a goodwill measure, provided no access has been activated and no content consumed, and, for a gifted pack, no key from the order has been activated, the buyer may request cancellation within 14 days via contact@playhana.com or Discord.
If game development is permanently abandoned before Alpha access opens, buyers will be refunded the price of their pack. Upon refund, associated rewards are removed from the account; for a gifted pack, keys are invalidated and recipients lose the pack received. Refunding a pack used as the basis for an upgrade results in the upgrade also being refunded and removed. No refund is due if an account is suspended or banned for violating the game's terms of use.
Nectar is a virtual currency usable only in Hana for cosmetic or convenience items. It has no monetary value, cannot be refunded or exchanged for real money, and cannot be transferred to third parties.
Alpha and Beta phases are test versions: interruptions, malfunctions and data resets (“wipes”) may occur. Founder pack cosmetic items are restored after each reset, and purchased Nectar is restored to the total acquired up to version 1.0 of the game; character progression is reset between phases. The Studio undertakes to supply purchased content but does not guarantee continuous service availability during testing phases.
The Studio cannot be held liable for indirect or unforeseeable damage, or in cases of force majeure. In all cases, its liability is limited to the amount paid by the buyer. Statutory guarantees of conformity for digital content (Articles L224-25-12 et seq. of the French Consumer Code) apply.
Order data is processed by the Studio and Stripe (payment processor) under the conditions described in the privacy policy. To apply Kickstarter pricing, the account email address is compared with the campaign backer list provided by Kickstarter.
Under Articles L611-1 et seq. of the French Consumer Code, the buyer may use a consumer mediator free of charge. Studio 3NA is currently finalising membership of an approved mediation service; contact details will be provided before the shop opens. The European online dispute resolution platform is available at ec.europa.eu/consumers/odr.
These Terms of Sale are governed by French law, without prejudice to mandatory provisions in the consumer's country of residence. If no amicable settlement is reached, French courts have jurisdiction.
