Terms of Use

1. Purpose and scope

These Terms of Use (the “Terms”) set out the rules for accessing and using playhana.com, the user account and services associated with the video game Hana (the “Site” and “Services”), published by Studio 3NA, a French SAS with share capital of €1 000, registered with the Perpignan Trade and Companies Register under number 992 999 144, whose registered office is at APP 12, 6 Rue Antoni Gaudi, 66270 Le Soler, France (the “Studio”, “we”).

Hana is a free-to-play, turn-based tactical MMORPG, currently in development and accessible during testing phases (alpha, beta). These Terms apply to anyone accessing the Site or using the Services (the “User” or “you”).

These Terms do not govern the sale of founder packs and paid content, covered by the Terms and Conditions of Sale, or the processing of your data, described in the privacy policy and cookie policy.

2. Acceptance of the Terms

Using the Services requires full and unconditional acceptance of these Terms. By creating an account or using the Services, you acknowledge that you have read, understood and accepted them.

Minimum age. Accounts may only be created by people aged at least 13 years. If you are aged 13 to 17, you declare that you use the Services with the prior permission of at least one person with parental responsibility, who accepts these Terms on your behalf and guarantees your compliance. The Studio reserves the right to request confirmation of this permission.

Reconfirmation on reaching adulthood. When you turn 18 years, you will be asked to confirm your acceptance of the Terms again to continue using the Services in your own name. Certain features, particularly purchasing paid content, may be restricted to adults or require a legal representative's consent.

These Terms are always available on the Site. We encourage you to consult them regularly.

3. Definitions

  • Studio: Studio 3NA, publisher of the Site, Services and Hana game.
  • Site: playhana.com and its subdomains.
  • Services: all features offered through the Site (account creation and management, access to testing phases, rankings, personal area, devblog, etc.) and the Hana game.
  • User: anyone accessing the Site or using the Services.
  • Account: the personal area created by the User to access the Services, associated with a unique identifier.
  • User Content: any material published, transmitted or made available by a User through the Services (including public username, community contributions, comments, votes, suggestions and feedback).
  • Community platform / Games2gether (G2G): the third-party platform used by the Studio to engage its player community (see Article 9).
  • Nectar: in-game virtual currency with no monetary value, as defined in the Terms of Sale.

4. Account creation and management

Accessing the Services requires an account. Accounts are created exclusively through the third-party authentication providers offered on the Site: Google (“Sign in with Google”) or Discord. In this process, we receive certain information from these providers (including first name, surname, identifier and email address), under the conditions described in the privacy policy.

You agree to provide accurate information and keep it up to date. Your username and sign-in methods (including your linked Google and Discord accounts) are strictly personal and confidential. You are solely responsible for maintaining their confidentiality and for any activity carried out through your account.

You agree to notify us without delay at contact@playhana.com of any unauthorised use of your account or security breach. The Studio implements reasonable technical and organisational measures to protect accounts, without being able to guarantee absolute security.

5. Behaviour and conduct

You agree to use the Services fairly, in accordance with applicable laws, these Terms and other Users. The following are, in particular, strictly prohibited:

  • harassment, threats, intimidation and any abusive behaviour towards others;
  • hateful, discriminatory, racist, sexist, homophobic speech or incitement to violence;
  • illegal, defamatory, violent or pornographic content, or content violating human dignity;
  • content endangering minors in any form;
  • cheating, exploiting bugs, using unauthorised third-party software (bots, automation, modifications) and any action undermining fair play;
  • spam, unsolicited advertising, chain messages and commercial solicitation;
  • impersonation, including pretending to be a Studio member;
  • infringement of third-party or Studio intellectual property rights;
  • any attempt to gain unauthorised access to, alter, overload or disrupt the Services, servers or associated networks;
  • reselling, exchanging or transferring accounts, identifiers, Nectar or virtual items except where expressly authorised by the Studio.

The username you choose, which may be displayed publicly (for example in player rankings), must not be offensive, misleading or infringe third-party rights.

6. User Content (UGC)

The Services may allow you to publish User Content, including your public username and community contributions (comments, votes, suggestions, feedback) through the Games2gether platform (see Article 9).

Ownership. You retain ownership of the rights you hold in your User Content.

Licence granted to the Studio. By publishing User Content, you grant the Studio a non-exclusive, royalty-free, worldwide licence for the statutory term of protection, authorising it to host, reproduce, display, adapt, translate and use that content to operate, improve and promote the Services, Hana and its community, in any medium. This licence includes displaying your public community activity to Games2gether's business prospects and customers (B2B), under the conditions described in Article 9 and the privacy policy.

User warranties. You warrant that you hold all necessary rights to the User Content you publish, that it infringes no third-party rights (including intellectual property or privacy rights) and that it complies with applicable laws and these Terms. You indemnify the Studio against third-party claims relating to your User Content.

Moderation. The Studio may, without being required to do so, review User Content and remove, restrict access to or modify content contrary to these Terms or the law, under the conditions of Article 8.

7. Studio intellectual property

Hana, its universe (including the world of Nativi), storylines, characters, dialogue, illustrations, music, graphical and audio elements, source code, databases and associated trademarks, logos and names are the exclusive property of the Studio or its partners and are protected by intellectual property law.

The Studio grants you a personal, non-exclusive, non-transferable and revocable right to use the Services for strictly personal and non-commercial purposes, in accordance with these Terms. Any reproduction, display, adaptation or exploitation of any part of the Services without the Studio's prior written authorisation is prohibited, subject to statutory exceptions and specific authorisations (for example through the press kit).

Nectar and virtual items are licensed for use within the game ; they confer no ownership rights and have no monetary value, in accordance with the Terms and Conditions of Sale.

8. Moderation and sanctions

If these Terms are breached, depending on the severity and recurrence of the facts, the Studio may take one or more of the following measures:

  • a warning to the User;
  • removal or modification of the User Content concerned;
  • temporary suspension of access to all or part of the Services;
  • banning (permanent termination) of the account.

Except in emergencies, serious breaches, legal obligations or risks to other Users, the Studio endeavours to inform the User of the measure taken and its reason. The User may challenge a measure by writing to contact@playhana.com ; the Studio reviews the request within a reasonable time. Measures concerning manifestly illegal content may be immediate. No refund is due for sanctions resulting from a User's breach.

Reporting content. Under applicable regulations, including the European Digital Services Act, any User may report content they consider illegal or contrary to these Terms to contact@playhana.com. The Studio examines each report and responds appropriately within a reasonable time.

9. Games2gether platform (G2G)

To engage its community, collect your feedback and build the game experience together, the Studio uses the third-party community platform Games2gether (“G2G”). When you participate in the community, your contributions and engagement data are hosted and processed on that platform, which may have its own terms of use.

In this context, certain data relating to your public community activity (for example username, avatar, public contributions, engagement statistics) may be presented or displayed to Games2gether's business prospects and customers (B2B) to demonstrate and promote the platform. The arrangements, legal basis and your rights (including your right to object) are detailed in the privacy policy.

10. Limitation of liability

Hana is in development. Testing phases (alpha, beta) are unfinished versions : interruptions, malfunctions, loss of progression and data resets (“wipes”) may occur. Content, features, schedules and rewards may change.

Progress made during testing phases (levels, items obtained in game, statistics) is not intended to be retained and may be reset at any time, except where the Studio expressly announces otherwise. Founder pack rewards and items are restored after each reset, in accordance with the Terms and Conditions of Sale.

The Services are provided “as is” and subject to availability. The Studio does not guarantee continuous, uninterrupted or error-free operation and may suspend, modify or discontinue all or part of the Services, particularly for maintenance, technical development or security reasons.

The Studio cannot be held liable for indirect or unforeseeable damage, or damage resulting from force majeure, improper use of the Services by the User, or third-party services (Google, Discord, Games2gether, hosting provider, etc.). These provisions apply within the limits permitted by law and cannot exclude the Studio's liability for gross negligence or wilful misconduct, or mandatory statutory consumer guarantees.

11. Personal data

The processing of your personal data through the Services is described in the privacy policy and cookie policy, which form an integral part of the information provided to you. They explain, in particular, the purposes of processing, retention periods and how to exercise your rights (access, rectification, erasure, objection, etc.).

12. Changes to the Terms

The Studio may change these Terms at any time, particularly to reflect changes to the Services or regulations. The applicable version is the one in force and available on the Site when you use it ; its update date appears at the top of this page. If a substantial change is made, we endeavour to inform you appropriately. Continued use of the Services after the amended Terms take effect constitutes acceptance of them.

13. Account termination

By the User. You may stop using the Services at any time and request deletion of your account without giving a reason by writing to contact@playhana.com. The Studio will confirm effective deletion within a maximum of 30 days.

By the Studio. The Studio may suspend or terminate your account for a breach of these Terms under Article 8, or if the Services cease. Termination results in loss of access to the account and associated content and benefits (including Nectar and virtual items), without prejudice to provisions of the Terms and Conditions of Sale concerning paid content. Provisions which by nature are intended to survive (including intellectual property, warranties and liability) remain applicable after termination.

14. Applicable law and jurisdiction

These Terms are governed by French law. In the event of a dispute, if no amicable settlement is reached, French courts have jurisdiction, subject to applicable mandatory jurisdiction rules, particularly those protecting consumers, who may bring proceedings in the courts of their place of residence. Consumers may also use a consumer mediator and access the European online dispute resolution platform (ec.europa.eu/consumers/odr).

15. Video content creation and streaming

The Studio encourages community content creation. You may capture, broadcast and publish images and videos from Hana (screenshots, videos, Let's Plays, live streams on platforms such as YouTube, Twitch or equivalents) for personal or content creation purposes, including customary monetisation of your channels (advertising, subscriptions, donations), subject to the following conditions:

  • state that the content comes from Hana and, where possible, mention its source;
  • do not imply that your content is officially produced, sponsored or approved by the Studio without its written consent;
  • do not publish confidential or embargoed content (for example during testing phases covered by a specific agreement) without prior authorisation;
  • comply with these Terms, applicable laws and the terms of the broadcasting platforms.

The Studio may clarify or adapt these rules and withdraw this permission in the event of misuse or use contrary to its interests. Game elements remain the Studio's exclusive property (Article 7).
